Welcome to Sharii. These Terms & Conditions ("Terms") govern your use of the Sharii website ("Website") and the purchase of products from Sharii Pty Ltd ("Sharii", "we", "our" or "us").

By accessing our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please refrain from using the Website.

We take great care to ensure every detail of your experience with Sharii is considered. These Terms are designed to provide clarity about how we operate and to help you shop with confidence.

These Terms apply to all visitors, customers and users of the Website.

We reserve the right to amend these Terms from time to time. Any updates will take effect upon publication on this Website. Your continued use of the Website constitutes acceptance of any revised Terms.

2. Products

Every Sharii collection is thoughtfully designed in-house with great attention to detail.

While we make every effort to accurately display our products, colours may vary slightly depending on your device or screen settings.

As our garments feature natural fibres, original artwork, embroidery and handcrafted details, slight variations in colour, texture or finish may occur. These natural variations form part of the character of the garment and are not considered faults.

3. Pricing

Unless otherwise stated, all prices are listed in Australian Dollars (AUD).

Prices include Australian GST where applicable.

We reserve the right to change prices at any time without prior notice.

In the event of a genuine pricing or product information error, we reserve the right to cancel or refuse any affected order. If payment has already been processed, a full refund will be issued.

4. Product Availability

We make every effort to ensure stock availability displayed on our Website is accurate. Occasionally, due to inventory discrepancies or high demand, an item may become unavailable after an order has been placed.

Should this occur, we will notify you as soon as possible and offer either:

·        a full refund;

·        where appropriate, an alternative product or size.

5. Orders

After placing an order, you will receive an email acknowledging receipt of your order. This email does not constitute acceptance of your order.

Orders are accepted once payment has been successfully processed and your order has been prepared for dispatch.

We reserve the right to decline or cancel an order where:

·        payment cannot be authorised;

·        fraudulent or suspicious activity is suspected;

·        products become unavailable;

·        incorrect pricing or product information has been published due to an error; or

·        we are otherwise unable to fulfil the order.

If your order is cancelled after payment has been received, a full refund will be provided.

6. Changes or Cancellation of Orders

Our team begins preparing orders as quickly as possible to ensure prompt dispatch. For this reason, we cannot guarantee that changes or cancellations can be accommodated once an order has been placed.

If you need to amend your order, please contact us immediately at info@sharii.world. If your order has not yet entered processing, we will do our best to assist.

7. Payment

Payment must be received in full before an order is dispatched.

Payments are securely processed through trusted third-party payment providers available at checkout.

Sharii does not store your complete credit card or payment information.

8. Shipping

Shipping, delivery timeframes, shipping services, international shipping, customs, duties, taxes and delivery issues are governed by our Shipping Policy.

We currently ship within Australia and internationally to New Zealand and Singapore. Shipping services and costs are displayed at checkout.

Nothing in these Terms limits or excludes any rights you may have under applicable law in relation to delivery or your order.

9. Returns & Exchanges

Returns, exchanges, refunds and faulty or incorrect products are handled in accordance with our Returns & Exchanges Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under Australian Consumer Law.

10. Promotions & Discount Codes

From time to time, Sharii may offer promotional discounts or special offers.

Unless otherwise stated:

·        only one promotional code may be used per order;

·        discount codes cannot be applied retrospectively;

·        promotions cannot be exchanged for cash; and

·        Sharii reserves the right to withdraw or amend promotions at any time.

11. Gift Cards

If Sharii introduces digital or physical gift cards in the future, additional Gift Card Terms may apply.

Gift cards are non-refundable and cannot be redeemed for cash unless required by law.

12. Intellectual Property

All content available on this Website is owned by or licensed to Sharii Pty Ltd and is protected under Australian and international intellectual property laws.

This includes, but is not limited to:

·        original artwork and prints;

·        embroidery designs;

·        garment designs and silhouettes;

·        illustrations;

·        logos and branding;

·        product names and collection names;

·        photography and videography;

·        website graphics, layout and design; and

·        written content.

Every Sharii collection is designed in-house, and all original prints, embroideries, illustrations and design concepts remain the exclusive intellectual property of Sharii Pty Ltd.

You may not reproduce, copy, distribute, modify, manufacture, publish, sell or otherwise exploit any part of our intellectual property without our prior written permission.

Nothing within these Terms grants any licence or ownership rights in our intellectual property other than the limited right to browse this Website and purchase products for personal, non-commercial use.

Sharii reserves all rights to protect and enforce its intellectual property.

13. Website Use

You agree not to:

·        use the Website for unlawful purposes;

·        interfere with the security or operation of the Website;

·        attempt unauthorised access to our systems;

·        introduce malicious software or viruses; or

·        misuse or copy Website content without permission.

15. Limitation of Liability

To the maximum extent permitted by law, Sharii shall not be liable for any indirect, incidental or consequential loss arising from the use of this Website or the purchase of our products.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees or rights that cannot be excluded under Australian Consumer Law.

Sharii shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control.

·        pandemics;

·        customs delays;

·        government restrictions; or

·        failures of third-party shipping providers.

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising from these Terms or the use of the Website shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
